| dc.description.abstract | تناولت دراستنا هذه موضوع تنفيذ عقد التأمين في القانون الجزائري ، ذو الأهمية البالغة في و قتنا الحالي، و خير دليل على ذلك تدخل المشرع بفرض بعض أنواعه و صوره بنصوص قانونية . لقد قمنا بتقسيم موضوع الدراسة إلى فصلين رئيسيين : في الفصل الأول : تناولت التزامات و حقوق المؤمن له و هي لكثرتها ارتأيت تقسيمها إلى مبحثين ، المبحث الأول تكلمت فيه عن التزامات المؤمن له في إطار تنفيذ عقد التأمين بوجه عام ، و وقد تناولناها في ثلاثة مطالب متتالية ،بينت من خلالها مضمون هذه الالتزامات و الأثر المترتب على مخالفتها ، أما المبحث الثاني فقد تناولنا فيه حقوق المؤمن له ، ارتبط ظهورها بوجود عقد التامين وقد ناقشناها في مطلبين المطلب الأول تناولنا فيه حق المؤمن له في مبلغ التامين ، أما المطلب الثاني تناولنا فيه حق المؤمن له في مبلغ التعويض. أما الفصل الثاني فقد خصصناه لدراسة شركة التأمين حقوقها والتزاماتها، وذلك ضمن مبحثين تناولنا فيهما المبحث الأول شكل شركات التأمين وفي المبحث الثاني حقوق والتزامات المؤمنالمتمثلة في تأمين الأشخاص، وكذلك التزامات المؤمن في تأمين الأضرار بنوعيه تأمين الأشياء وتأمين المسؤولية. Summary: Our study dealt with the implementation of the insurance contract in Algerian law, which is very important in our current era, and the best evidence of this is the legislative intervention by imposing certain kinds of legal provisions. We have divided the subject into two main chapters: In the first chapter, I addressed the obligations and rights of the insured and, for their wealth, divided them into two monographs, the first in which I spoke about the obligations of the insured within the framework of the general implementation of the insurance contract, and we discussed them in three successive demands, the content of these obligations and the effect of their breach, and the second in which we discussed the insured's rights in the amount of the insurance claim. Chapter II devoted it to the examination of its rights and obligations by the insurance company. | en_US |
