| dc.description.abstract | Studying the status of the public employee constitutes one of the central problems in the system of public employment and administrative law, as the public employee is considered a difficult figure in the field of public employment in particular and administrative law in general. Our analytical study of the status of the public employee in Algerian legislation has yielded important results, the most prominent of which is the definition of the public employee through Order 06/03 relating to public employment despite the multiplicity of texts regulating this field, which defines him in its fourth article as: "Every employee appointed to a public job is considered an employee ." Permanent and ranked in the administrative ladder " The diversity of the activities of the state and its administrative agencies leads to varying conditions for its employees, as the most important category of employees due to their direct connection to public facilities is subject to the provisions of public law and administrative judiciary, while other categories of employees are subject to the provisions of private law and ordinary judiciary However, the Algerian legislator has guaranteed the public employee a package of basic financial rights, which lie in financial rights during the performance of his job, which are represented in the salary, its supplements, and both types of promotion, and financial rights after his retirement, which are mainly represented in the retirement pension (ttransferred pension and direct pension). | |
