| dc.description.abstract | إن الشريعة الإسلامية وقانون الأسرة الجزائري قد منحا للزوج الحق في إنهاء الرابطة العلاقة الزوجية ومنعا الزوجية بإرادته المنفردة، إلا أنهما وحفاظا على التوازن بين أطراف من تعسف الزوج في استعمال حقه في فك الرابطة الزوجية فقد وضعا للزوجة وسيلتين لإنهاء رابطة زوجية صارت لا تطيقها. ورغم اشتمال قانون الأسرة الجزائري على مختلف القواعد المنظمة للأسرة إلا أنه في الجانب الإجرائي لم يتطرق إلى إجراءات رفع الدعوى وقواعد الاختصاص وطرق الطعن وغيرها من القواعد، مما يقودنا إلى ضرورة الرجوع إلى أحكام قانون الإجراءات المدنية والإدارية. الكلمات المفتاحية: قانون الأسرة ، التطليق،الخلع Summary: Islamic law and Algerian family law have granted the husband the right to terminate the marital relationship and prevent the marriage by his own will, but in order to maintain a balance between parties from the husband's abuse of his right to break the marital bond, they have placed the wife and two means of ending a marital bond that she cannot afford. Although Algerian family law contains various rules governing the family, on the procedural side it did not address the procedures for filing proceedings, jurisdictional rules, appeal methods and other rules, leading us to the need to refer to the provisions of the Civil and Administrative Procedure Act.
