| dc.description.abstract | لقد حدد المشرع الجزائري المصلحة المتعاقدة في المرسوم الرئاسي 15-247 المتعلق بتنظيم الصفقات العمومية وتفويضات المرفق العام باعتبارها ممثل المصلحة العامة فتمثلت في الدولة والجماعات الإقليمية والمؤسسات العمومية ذات الطابع الإداري والمؤسسات العمومية الخاضعة للتشريع الذي يحكم النشاط التجاري، عندما تكلف بإنجاز عملية ممولة كليا أو جزئيا بمساهمة مؤقتة أو نهائية من الدولة أو الجماعات الإقليمية. لقد اعترف المشرع الجزائري في مركز ممتاز للمصلحة المتعاقدة في مختلف قوانين الصفقات العمومية، وهذا المركز يتمثل في: الحقوق (السلطات) أو الواجبات( الإلتزامات ) عبر مراحل الصفقة العمومية أي أثناء الإبرام وأثناء التنفيذ. الكلمات المفتاحية: الشفافية، الصفقة العمومية، المصلحة المتعاقدة، المرسوم 15-247in Presidential Decree 15-247 related to the organization of public procurements and public utility mandates as a representative of the public interest.
