Abstract
من خلال ما تقدم يظهر جليا أهمية السر المهني في الوظيفة العمومية و بقدر ما هو واجب ملقى على عاتق الموظف إلا أنه في الواقع واجب أخلاقي وجب التحلي به ، و عدم إفشائه للغير و عدم الإفصاح بمختلف المعلومات التي أطلع عليها بحكم وظيفته ، و رغم مبادرة المشرع لجملة من القوانين التي تناولت الظاهرة قصد حماية مصلحة الأفراد من جهة و المصلحة العامة من جهة أخرى ، و ما يترتب على الموظف العمومي من جزاءات جراء الإخلال بحماية هذه الأسرار ، إلا أنه لم يترك يد الإدارة ممدودة في ممارسة سلطتهــــــا الرئاسيـــــــــــة على الموظف، و ما يترتب على ذلك من عقوبات تأديبيـــة في الغـالب و أحيانا أخرى مدنية و قد تكون جزائية ، بل ربط ذلك بتوفير ضمانات للموظف في مواجهة مختلف إجراءات المتابعة .
Summary
Through the foregoing ,the importance of professional secret in the public office is evident ,and us much it is a duty placed on the employee in fact ,it is morale duty that must be adhered to , and not to disclose it to others not to disclose the various information that the was briefed on by virtue of this job , despite the legislator intiative mentioned a number of laws that dealt with the phenomenon in order to protect the interest of individuals on the one hand and the public interst on the other hand ,and the consequences of a public official as a result of breaching the protection of these secrets , but the did not leave the administrations hand extended in the exercise of its presidential authority over the employee, and what this entails mostly disciplinary penalties ,and sometime civil and may be penal ,rather linking this to providing guarantees to the employee in the face of various follow-up procedures.
