| dc.description.abstract | من خلال دراستنا لموضوع حقوق الضحية في التشريع الجزائري بصفة عامة وفي قانون الإجراءات الجزائية بصفة خاصة, و التي من خلالها عمل المشرع الجزائري على تدعيم هذه الحقوق وذلك من خلال منح الضحية عدة إجراءات لضمان حماية مركزة و تعزيز مكانته أمام أجهزة العدالة في مختلف المراحل بما في ذلك أمام قضاء الحكم حيث أعطاه حق الادعاء المباشر في تحريك الدعوى العمومية. كذلك حق تقييد حرية النيابة العامة في تحريك الدعوى العمومية وهذا عن طريق قيد الشكوى كما إعطاء حق الادعاء المدني في مختلف مراحله في بداية التحقيق أو عند نهايته, فبالإضافة إلى حق الضحية في إنهاء ىالدعوى العمومية في جرائم محددة في قانون الجزائي الجزائري . كما أن المشرع قد اهتم بحقوق الضحية من خلال تقرير التعويض عن الضرر الناجم من جراء الجريمة سواء كان هذا الضرر ماديا أو نفسيا أو شخصيا أو معنويا .... الخ . Through our study of the subject of the rights of the victim in Algerian legislation in general and in the code of criminal procedure in particular, through which the Algerian legislator has worked to consolidate these rights by granting the victim several measures to ensure protection targeted and strengthen its position before the courts at various stages, in particular: It is before the court in power, which gave it the right to appeal directly to initiate the public trial. Likewise, the right to restrict the freedom of the prosecution to initiate a public case consists of registering the complaint and giving the right to civil proceedings at its various stages of development. The beginning or the end of the investigation, in addition to the victim's right to end public prosecutions for specific offenses in the Algerian penal code. In addition, the legislator has ensured the rights of the victim by deciding on compensation for the damage caused by the crime, whether this damage is material, psychological, personal or moral . | en_US |
