| dc.description.abstract | إن براءة الاختراع هي من أهم صور الملكية الصناعية، نظرا لما ترتبه من آثار قانونية واقتصادية تنتج عند استغلالها خاصة مع التقدم العلمي والتكنولوجي الهائل في وقتنا الحالي حيث تم الاهتمام بالاختراعات التي أصبحت أساس للتطور و النمو، والمشرع الجزائري قد أعطى أهمية لبراءة الاختراع من خلال تنظيمها و حمايتها، حيث أقر شروطا موضوعية وشكلية للحصول على ملكية براءة الاختراع وهذا ما جاء به الأمر رقم 03-07 المتعلق ببراءة الاختراع. إن منح ملكية براءة الاختراع لصاحبها تمنحه حق التصرف باستغلال هذا الاختراع دون غيره، وهذا ما يضع التزاما على الغير بعدم الاعتداء على حق صاحب البراءة دون إذن من صاحبها، وإلا كان عرضة للعقوبات الجنائية المقررة في الأمر رقم 03-07 الذي من خلاله منح المشروع الجزائري لمالك البراءة الحق في الدفاع عن ملكية براءته عن طريق رفع دعوى التقليد ضد كل من قام بتقليد اختراعه وأقر المشرع لذلك عقوبات أصلية وتكميلية. ا Summary: The patent is one of the most important forms of industrial property, owing to its legal and economic implications, produced when exploited, especially with the tremendous scientific and technological progress of our time, where attention has been paid to inventions that have become the basis for development and growth.
