Abstract
تناولت هذه الدراسة البحث في موضوع التسيير المفوض لمرفق المياه، والتسيير المفوض أحد أساليب تسيير المرافق العامة، التي عرفها المرفق العام في الجزائر لأول مرة في قطاع الموارد المائية، بموجب قانون المياه رقم 05-12 المعدل والمتمم، هذا الأخير الذي أسس لأول مرة في التشريع الجزائري بنص صريح لهذا الأسلوب، منظما إياه بأحكام خاصة يظهر من خلالها باعتباره أسلوب تسيير مستحدث يعيد تنظيم العلاقة القائمة بين القطاعين العام والخاص في إطار تعاقدي، ضمن آليات عقدية موضوعها الأساسي الاستثمار في مجال تسيير الخدمات العمومية.
وقد ظلت الأحكام الخاصة بالتفويض في قانون المياه، الأساس القانوني الأول لهذا الأسلوب في التشريع الجزائري، حتى تمت تزكية تلك الأحكام، بالأحكام العامة المنظمة لتفويض المرفق العام، في كل من قانون البلدية رقم 11-10 ، والمرسوم الرئاسي رقم 15-247 ، المتعلق بالصفقات العمومية وتفويضات المرفق العام، وهي الأحكام التي يتحدد بموجبها معنى التسيير المفوض لمرفق المياه في إطار هذه الدراسة.
This study dealt with research on the issue of delegated management of the water utility, and delegated management is one of the methods of managing public utilities, which the public utility in Algeria knew for the first time in the water resources sector, under Water Law No. 05-12 amended and supplemented, the latter which was established for the first time in legislation Algerian explicit text for this method, organizing it with special provisions through which it appears as an innovative management method that reorganizes the existing relationship between the public and private sectors within a contractual framework, within contractual mechanisms whose main subject is investment in the management of public services.
The provisions related to delegation in the Water Law remained the first legal basis for this method in Algerian legislation, until those provisions were recommended by the general provisions regulating the delegation of the public utility, in both Municipal Law No. 11-10 and Presidential Decree No. 15-247, relating to deals Public utility and public utility delegations, which are the provisions under which the meaning of delegated management of a water utility is defined within the framework of this study.
