| dc.description.abstract | إن اتساع نطاق الوظيفة الإدارية أدى إلى ازدياد العبئ على الإدارة سواء على المستوى المحلي أو على المركزي، بالإضافة إلى ازدياد طلب الأفراد على المرافق العامة وتراكم الأعمال أدى إلى ظهور أسلوب التفويض الإداري باعتباره مسلكا للخروج من تعقيدات الوظيفة الإدارية، لأنه يهدف إلى تحقيق الفعالية والسرعة في انجاز الأعمال الإدارية، كما يخضع التفويض الإداري إلى قواعد تميزه عن غيره من الأساليب القانونية المشابهة له. ومن اجل إن نقتفي تصرفاته القانونية بالمشروعية وبالأخص ذات الطابع الاستثنائي، وجب توفر جملة من الضوابط والأسس التي يجب مراعاتها وهذا ما نجده في الشروط الخاصة بالتفويض الإداري، وانه في حالة عدم احترام هذه الشروط، فلا شك إن التفويض يفقد مشروعيته، فدراسة التفويض تدل على أهمية أثار القانونية والمادية التي تنتج من خلاله بل الإضافة إلى ذلك فإن التفويض يمتاز بأهمية كبيرة باعتباره وسيلة فعالة في مساعدة رؤساء الإدارة على التخلص من الأعباء الإدارية الثانوية التي تثقل كاهلهم وأنه أصبح ضرورة من الضروريات لحسن تنظيم العمل الإداري، The expansion of the administrative function led to an increase in the burden on the administration, whether at the local or central level, in addition to the increase in individuals’ demand for public utilities and the accumulation of work, which led to the emergence of the method of administrative delegation as a way out of the complexities of the administrative function, because it aims to achieve efficiency and speed in Completion of administrative work, and administrative delegation is subject to rules that distinguish it from other similar legal methods In order to trace his legal actions with legitimacy, especially of an exceptional nature, a number of controls and foundations must be available that must be observed, and this is what we find in the special conditions for administrative delegation, and that in the event of non-respect of these conditions, there is no doubt that the delegation loses its legitimacy, the study of delegation indicates the importance of The legal and material effects that result from it Rather, in addition to that, the administrative delegation is of great importance as it is an effective means in helping the heads of the administration to get rid of the secondary administrative burdens that burden them and that it has become a necessity for the proper organization of administrative work. | en_US |
