| dc.description.abstract | خص المشرع الجزائري الأملاك الوطنية العمومية بحماية خاصة صارمة و متنوعة تقتضيها طبيعتها القانونية باعتبارها أموال مخصصة للمنفعة العامة، و بذلك تختلف عن الأموال الخاصة للأفراد و كذلك عن الأملاك الوطنية الخاصة، و بتعدد أوجه الحماية المقررة للأموال العمومية، تتعدد الأخطار التي قد تتعرض لها فقد يكون مصدرها سوء ادارة المال العام أو اهماله، أو التصرف فيه بصورة غير شرعية. و قد يكون مصدر هذه الأخطار الجمهور المستعمل عن طريق شغل الاموال العمومية بطرق غير مشروعة، أو وضع اليد عليها لمدة طويلة، أو الحجز عليها، أو الحاق أي ضرر بها قد يعرضها للاندثار أو التلف. و لذا كفلها المشرع بحماية ادارية، و أخري مدنية، و ثالثة جنائية. The Algerian legislature has privatized public national property with strict and varied special protection required by its legal nature as funds for public benefit. which differs from private funds for individuals as well as from private national property, With the multiple protections established for public funds, there are a number of risks to which public funds may be mismanaged, neglected or illegally disposed of. The source of these risks may be the public employed by illegally occupying, holding, seizing or damaging public funds for a prolonged period of time.
