abstract:
Commercial arbitration was considered the oldest in appearance for this, so we
find many jurists who expressed several definitions of it and dealt with its details
in terms of its use, the method of working with it in disputes, and even ways to
solve it, which made the owners of intellectual property rights more resort to it and
the increasing demand for it as a result of its rapid development, so arbitration is
considered a way In order to preserve their rights, knowing that the intellectual
property, in its two parts, literary and artistic property, as well as industrial and
commercial property, was not confined to a specific country and exceeded the
borders, so it decided the need to protect it at the internal and external levels
through organizations that provide international protection to its owners from third
parties, whatever their status, by adopting arbitration, its content, and its
procedures. Whether in the World Intellectual Property Organization, which
contributed to resolving its disputes by establishing a center for arbitration and
mediation, and developing and clarifying how arbitration begins and ends through
arbitration rules, or the World Trade Organization, which clarified its procedures
in the Memorandum of Understanding regarding the rules and procedures
governing the settlement of disputes that were established in the agreement to
establish an organization international trade, and their development of the system
and keeping pace with technology to facilitate the arbitration process.
