| dc.description.abstract | - لقد مرت المسؤولية الجنائية الدولية للفرد في القانون الدولي الجنائي على العديد من المحطات و المراحل حتى انبثقت و ترسخت كمبدأ من مبادئ القانون الدولي المعاصر , انطلاقا من معاهدة فرساي بتجريم الأفعال المرتكبة في الحرب العالمية الأولى و المطالبة بمحاكمة مجرمي الحرب و أبرزهم الامبراطور (غيوم الثاني) تمهيدا لمبدأ المسؤولية الجنائية للفرد , يليها مبدأ عدم الإعتداد بالحصانة القضائية للأفراد بمحكمة نورمبرغ و التي أيدتها محكمة طوكيو في جل المبادئ ما عدى المركز الرسمي للفرد مرتكب الجريمة و الذي يمكن اعتباره ظرفا مخففا للعقاب , و تعتبر محاكمتي يوغسلافيا و رواندا تأكيدا صريح لمبدأ المسؤولية الجنائية الدولية للفرد في القانون الدولي إلى حال أن استقر هذا المبدأ و صار من أهم مبادئ القانون الجنائي الدولي و معتمدا في نظام المحكمة الدولية الجنائية الدائمة التي أكدت بشكل صريح و مباشر مبدأ المسؤولية الفردية دون الإعتداد بالصفة الرسمية . - Abstract : - The international criminal responsibility of the individual in international criminal law has passed on many stations and stages until it emerged and took root as a principle of contemporary international law, based on the Treaty of Versailles criminalizing the acts committed in World War I and demanding the prosecution of war criminals, most notably emperor (Guillaume II) in preparation for the principle of criminal responsibility of the individual, followed by the principle of non-recrimination of the judicial immunity of individuals at the Nuremberg court, which was upheld by the Tokyo court in all principles except the official status of the individual perpetrator the crime, which can be considered a mitigating circumstance, The trials of Yugoslavia and Rwanda are an explicit confirmation of the principle of international criminal responsibility of the individual in international law until this principle is established and has become one of the most important principles of international criminal law and adopted in the system of the permanent criminal court Which explicitly and directly affirmed the principle of individual responsibility without re-acknowledging the official status. | en_US |
