| dc.description.abstract | تناول هذا البحث مسألة ميراث المرأة في الشريعة الإسلامية وقانون الأسرة الجزائري، حيث تم التطرق في البداية إلى ميراث المرأة في مختلف الحضارات وبعض التشريعات الغربية الحديثة، من أجل بيان نظرتها إلى توريث المرأة، ثم ركز على وجهة نظر الشريعة الإسلامية وقانون الأسرة الجزائري إلى كل ما يتعلق بميراث المرأة، من بيان أركان، وشروط، وموانع ميراثها، وصولا إلى حالات ميراث المرأة التي ليس للأنوثة تأثير عليها وإنما قد يساهم في التأثير على نصيبها فيكون أحيانا مساويا لنصيب الرجل وأحيانا أعلى من نصيبه وأحيانا أخرى قد يكون نصيبها أقل من نصيبه، وقد استمد قانون الأسرة الجزائري أحكامه في توريث المرأة من أحكام الفقه الإسلامي ، ولكنه لم يلتزم مرجعية فقهية واحدة بل اعتمد من الأحكام ما يتناسب وطبيعة المجتمع الجزائري. وبناء عليه فقد تم تقسيم البحث إلى فصلين، تناول الفصل الأول الناحية التاريخية والمفاهيمية لميراث المرأة، بينما تناول الفصل الثاني حالات ميراث المرأة. Abstract: Our research is an overview about the inheritance of women in Islamic law and Algerian family law, where it discusses the inheritance of women in various civilizations and some modern Western legislations in order to explain their view on women's inheritance. Then, it focuses on the view of Islamic law and Algerian family law. The inheritance of women, from the statement of pillars, conditions, and impediments to inheritance, to the cases of inheritance of women, which is not affected by the impact on women, but may contribute to the impact on their share is sometimes equal to the share of men and sometimes higher than its share and other times may be less than its share, The Algerian family law derived its provisions on the inheritance of women from the provisions of Islamic jurisprudence, but did not adhere to a single jurisprudential reference, but adopted the provisions commensurate with the nature of Algerian society. Accordingly, the research is divided into two chapters.
