| dc.description.abstract | یتضح مما سبق أن المشرع سعى جاهدا إلى حمایة المتضررین من أرباب عمل وغیرهم من كل حوادث البناء من تهدم وغیره من ضرر وذلك من خلال ما نص علیه من قواعد عامة وخاصة رغم ذلك تبقى هذه الحمایة نسبیة أو محدودة إن صح التعبیر وذلك من خلال عدة نقائص من أبرزها أنها لا تشمل كل الأضرار لأنها تستثني الثانویة ولا تشمل كل الأشخاص بل البعض ففي هذه المسؤولیة یستثني المقاول الفرعي مثلا أو مساعد البناء، رغم كل هذا تبقى ذات حلول مجدیة للحد من تهاون في إنشاء المشاریع وغیرها من المنشآت سواء ذات الصالح العام أو الخاص مع تمنیاتنا بأخذ الاقتراحات التي قدمناها بعین الإعتبار سواء من حیث الأضرار التي یجب أن تشملها هذه المسؤولیة أو الأشخاص الذین تشملهم أو المدة الأنسب لها. Abstract: From all the above, it is clear to us that the legislature has endeavoured to protect those affected by employers and other constructive accidents from destruction and other damage through its general and special rules.
