| dc.description.abstract | تناولت الدراسة تحليال لتأثير تعيين الحكمين على استمرار العالقة الزوجية في الفقه اإلسالمي وقانون األسرة الجزائري، وذلك لما تعرفة العالقة الزوجية من تتعدد المشاكل والخالفات في الحياة الزوجية، وقد يواجه الزوجان صعوبة في حلها بأنفسهم، هنا يأتي دور تعيين الحكمين، الذين يعتبرون ، ففي الفقه اإلسالمي يتم طرفًا ثالثًا محايدًا يساعد على إعادة التوازن والتوصل إلى حلول متفق عليها تعيين الحكمين من خالل ما يعرف بـ"التحكيم"، حيث يتم اختيار شخص ثالث للنظر في الخالفات الزوجية واتخاذ قرار يلتزم به الزو جان و يعتبر التحكيم وسيلة إلعادة السلم والسكينة في العالقة الزوجية، ويساهم في تجنب الطالق وتفاقم المشاكل األسرية، من جهة أخرى، فالتحكيم في قانون األسرة الجزائري، التو اصل والتفاهم بين الزوجين، وتقديم حلول قانونية عادلة للشقاقات الزوجية. يعتبر دور الحكمين في هذا السياق مهمًا لتسهيل يتم بتعيين الحكمين عن طريق المحاكم القضائية، و الكلمات المفتاحية: تعيين الحكمين، العالقة الزوجية، الفقه اإلسالمي، قانون األسرة الجزائري. Summary: The study analysed the impact of the appointment of the two rulers on the continuation of marital relations in Islamic jurisprudence and Algerian family law In view of the many problems and differences in matrimonial life, The spouses may have difficulty solving it themselves, here comes the role of appointing the two rulers, Who are considered a neutral third party that helps to rebalance and reach agreed solutions In Islamic jurisprudence, the two rulers are appointed through what is known as "Arbitration", where a third person is selected to consider marital disputes and make a decision to which the spouses are bound. Arbitration is considered a means of restoring peace and tranquillity in the marital relationship; It contributes to avoiding divorce and exacerbating family problems, on the other hand, The arbitration of Algerian family law is done through the judicial courts. The role of the two rulers in this context is important to facilitate communication and understanding between the spouses, and to provide fair legal solutions to marital disagreements.
