| dc.description.abstract | إن االجتهادات القضائية لمجلس الدولة تعتبر أحد أهم المصادر التي يعتمد عليها القاضي اإلداري في حل المنازعات المعروضة أمامه، فبعد تبني نظام االزدواجية القضائية في الجزائر منذ سنة ،1996 أوكلت مهمة توحيد االجتهاد القضائي لهذه الهيئة القضائية اإلدارية العليا في البالد، غير أن القرارات القليلة التي تنشر في المجالت المتخصص ال تكشف حقيقة مضمونها، وهذا يؤثر سلبا عليه، إضافة إلى ضغوط السلطة التنفيذية تجعل من اجتهادات مجلس الدولة محدودة الهدف. الكلمات المفتاحية: االجتهاد القضائي، القاضي اإلداري، مجلس الدولة Abstract: The judicial jurisprudence of the State Council is considered one of the most important sources relies on, to resolve the dispute before it, so after adopting the system of judicial dualism in Algeria since 1996, the task of unifying judicial jurisprudence was assigned to this high administrative judicial in the country, but the few decisions that are published in the special journals do not reveal their content which negatively affects for it, and the pressure of the executive authority also makes the State Council’s jurisprudence limited in purpose.
