Abstract
ان العلاقة بين الجريمة المنظمة والفساد هي علاقة وظيفية وقانونية رسختها الدراسات القانونية، ونصت عليها اتفاقية الأمم المتحدة لمكافحة الجريمة المنظمة عبر الوطنية، وذلك من خلال اعتبار الفساد أحد الأنشطة البارزة للجريمة المنظمة.
وباعتبار الفساد يفرز الجريمة المنظمة، التي تعتبر بيئة الفساد أفضل مجالات اعمالها التجارية غير المشروعة، وهو ما يبرر العلاقة الطردية المتبادلة بين الجريمة المنظمة والفساد، فكيما انتشر الفساد تفاقمت الجريمة المنظمة، وهو ما يسمح بتطور قدرتها وتضخم عائدتها المادية، وبالتالي توسع قدرتها على استقطاب مفسدين جدد، وانتشار ممارستها السلبية والتأثير على مراكز نفوذ وسلطات أكبر.
Summary :
The relationship between organized crime and corruption is a functional and legal relationship established by legal studies, and stipulated by the United Nations Convention against Transnational Organized Crime, by considering corruption as one of the prominent activities of organized crime.
And given that corruption produces organized crime, the environment of corruption is considered the best area of its illegal business, which justifies the mutual relationship between organized crime and corruption. They renewed their negative practices, and affected the centers of influence and greater powers.
