| dc.description.abstract | تعتبر الاستثمارات الأجنبية ركيزة في تحقيق التنمية الاقتصادية ، وقد عمدت الج ا زئر الى فتح أبوابها للمستثمرين الأجانب لاستقطاب اكبر قدر ممكن من رؤوس الأموال الأجنبية ،ولقد تبنى المشرع الج ا زئري نظاما قانونيا لحماية عقد الاستثمار الأجنبي من مخاطر غير تجارية التي تعتبر من أهم المعوقات التي يمكن ان يتعرض لها ، والتي تحد من رغبة شركات الاستثمار الأجنبية في تحقيق مشاريعهم الاستثمارية ، لذلك وفي سبيل تبديد مخاوف المستثمر الأجنبي وتعزيز ثقته قام المشرع بتوفير الضمانات القانونية اللازمة لحمايته ، غير ان هذه الأخيرة لا تتسم بالفعالية إذا لم تحط بآلية دولية المتمثلة في عقود الضمان . لكن إب ا رم هذه الأخيرة يعني بالضرورة وفود الاستثما ا رت الأجنبية الى الدول النامية ، لأن ذلك متوقف على عوامل أخرى تتطلب معالجتها من خلال تحسين مناخ الاستثمار في جميع جوانبه . Study Summary: Foreign investment is considered as a basis for economic development. Algeria has opened its doors to foreign investors in order to attract as many foreign investments as possible. The Algerian legislator has adopted a legal system for the protection of foreign investment contract against non-commercial risks which are considered as one of the most important obstacles that it faces since they limit the desire of foreign investment companies to realize their projects. Therefore, and in order to dispel the fears of the foreign investor and gain his confidence, the legislator has provided the necessary legal guarantees for its protection but these remain ineffective if they are not framed by an international mechanism which is the guarantee agreement. However, the conclusion of this contract does not necessarily implies the attraction of foreign investments to developing countries since these depend on other factors that need to be addressed by improving the investment climate in all its aspects. | en_US |
