Abstract
يأتي هذا البحث كمحاولة جادة لمعرفة مدى توفر ومكانة المصالح المرسلة في الفقه والتشريع المالكي, وقد تطرقنا اليها من خلال دراسة كتب النوازل وابرزها كتاب الإمام البرزلي المعروف باسم جامعمسائلالأحكام,واهميتهالفقهيةوالتاريخية, وبينا في هذا البحث كل ما يتعلق بهذا الكتاب وكذا الامام البرزلي, اضافة الى الحياة الاقتصادية في المغرب من خلال نوازل تطبيقات المصلحة, محاولين اعطاء تبسيط وتوضيح لمكانة المصالح المرسلة في التشريع المالكي
This research comes as a serious attempt to find out the availability and status of the mursal interests in Maliki jurisprudence and legislation. We have touched on them through studying the books of calamities, most notably the book of Imam al-Barzali, known as Jami’ Masa’il al-Ahkam, and its jurisprudential and historical importance. We have explained in this research everything related to this book as well as Imam al-Barzali. , in addition to the economic life in Morocco through the calamities of the interest’s applications, trying to give simplification and clarification to the status of the sent interests in Maliki legislation.
