| dc.description.abstract | أدت مختلف التحولات الإقتصادية إلى إنسحاب الدولة من الحقل الإقتصادي وتبني نظام اقتصاد السوق، ولكن هذا الانسحاب لم يكن كليا حيث استحدثت طرق جديدة للتدخل من أجل إرساء مبدا المنافسة الحرة، باستحداث هيئات جديدة عرفت بالسلطات الإدارية المستقلة، والتي أسند لها ضبط مختلف القطاعات على غرار قطاع البريد والإتصالات الذي يعرف تطورات هامة ما إستدعى إنشاء سلطة ضبط البريد والإتصالات التي تسير بموجب القانون 18 – 04، ولعل من أهم المسائل التي تثيرها إنشاء هذه السلطة ما تعلق بطبيعته القانونية وخاصة إستقلاليتها، ولقد خولها المشرع من أجل ممارسة مهامها الضبطية إختصاصات متنوعة كسلطة للرقابة والقمع إضافة إلى الإختصاصين التحكيمي والإستشاري. الكلمات المفتاحية: سلطة الضبط، الإختصاص التحكيمي، سلطة الرقابة Summary: The various economic transformations have led to the withdrawal of the State from the economic field and the adoption of the market economy system, but this withdrawal has not been total, because new modes of intervention have been developed in order to to establish the principle of free competition, by creating new bodies called independent administrative authorities, which were responsible for controlling the various sectors such as the post and telecommunications sector, which is experiencing significant developments, required the establishment of the Post and Telecommunications Control Authority which operates in accordance with Law 18-04, and perhaps one of the most important questions raised by the creation of this authority is related to its legal nature, in particular its independence , and the legislator has empowered it to exercise its police missions various powers as an authority for control and repression in addition to the specialists of e arbitration and counsel. keywords: Regulatory authority, arbitral jurisdiction, supervisory authorit | en_US |
