Abstract
المسكن هو مستودع سر الأفراد، فلا يمكن الدخول إليه إلا برضا صاحبه، و إلا اعتبر انتهاكا لحرمته، فإذا كان صاحب المسكن مشتبه فيه أو متهم في ارتكاب جناية أو جنحة، جاز للسلطة العامة الدخول إليه و تفتيشه، وفقا لقواعد و شروط محددة، أهمها إذن صادر من سلطة قضائية مختصة، و قد يقوم بهذا الإجراء قاضي تحقيق إذا ما كان بصدد تحقيق قضائي، أو يندب لذلك ضابط شرطة قضائية، هذا الأخير له اختصاص أصيل بتفتيش المساكن في حالة الجريمة المتلبس بها، و يترتب على إجراء تفتيش مسكن ضبط ما يفيد في الكشف عن الحقيقة في جريمة ارتكبت، سواء كانت أشياء أو أوراق أو مستندات، و قد يكون بطلان ما أتخذ من إجراءات قبل أو أثناء أو بعد إجراء تفتيش المسكن، إذا لم تحترم الأحكام و القواعد المنصوص عليها في قانون الإجراءات الجزائية لدى التشريع الجزائري و معظم التشريعات المقارنة .

Abstract
The dwelling is the repository of the secrets of individuals, and it cannot be entered without the consent of its owner, otherwise it is considered a violation of its sanctity. And if the owner is suspect or accused in the commission of a felony or misdemeanor, the public authority permitting the entry for inspection in accordance with certain rules and conditions. Issued by a competent judicial authority, this procedure may be carried out by an investigating judge if he is in the process of a judicial investigation, a judicial police officer may be delegated for this as well. This last one is specialized in dwelling inspection in the case of a red-handed, and this needs to seizure what can help in revealing the truth in a crime committed, whether they are things, papers or documents, and the measures taken before, during or after the home inspection may be invalid, if the judgments and the rules set out in the Code of Criminal Procedure in Algerian legislation and most comparative legislation are not respected. .
