| dc.description.abstract | يعتبر النظام القضائي في الجزائر العثمانية بين 1519-1830م، حيث شكل القضاء أحد ركائز الدولة والمجتمع، معتمداً على المذهبين المالكي والحنفي، مع وجود القضاء العرفي في المناطق الريفية، كما تميز القضاء بالتعدد والتكامل من خلال إنشاء محكمتين مستقلتين لكل مذهب مع احترام حرية التقاضي، كما شمل النظام القضائي ثلاثة أنواع رئيسية: قضاء الخصومات، قضاء المظالم، وقضاء الحسبة، لكل منها وظائفه وشروطه الخاصة، وتعددت مؤسسات القضاء مثل المجلس العلمي الشريف، ومحاكم أهل الذمة، وقضاء الجماعة والمرابطين، وشهد القضاء تحولات في التعيين والعزل، وتفاوتت مدة الولاية تبعا للظروف السياسية، مما أفرز تحديات في النزاهة والانضباط داخل الجهاز القضائي. The judicial system in Ottoman Algeria (1519–1830) was one of the cornerstones of the state and society, relying on the Maliki and Hanafi schools of thought, with customary justice prevailing in rural areas, The system was characterized by diversity and integration, with two independent courts established for each school of law, while respecting the freedom of litigation. The judicial system included three main types: dispute resolution courts, grievance courts, and the ḥisba courts, each with its own functions and conditions, Judicial institutions were diverse, including the High Religious Council (al-majlis al-ilmi al-sharif), courts for non-Muslims (Ahl al-Dhimma), community courts, and MURABIṬIN (religious figures) courts. The judiciary witnessed changes in appointments and dismissals, with the term of office varying according to political circumstances, which gave rise to challenges in maintaining integrity and discipline within the judicial apparatus. | |
