| dc.description.abstract | نظم القانون العضوي رقم 98-01 المعدل والمتمم اختصاصات مجلس الدولة، التي تشمل اختصاصات قضائية وأخرى استشارية، هذه الاختصاصات عرفت تطورا ملحوظا نتيجة التعديل الدستوري سنة 2016 الذي أقرّ توسيع المجال الاستشاري ليمتد إلى إبداء الرأي في مشاريع الأوامر، أما في المجال القضائي فقد جاء في التعديل الدستوري سنة 2020 إنشاء محاكم إدارية استئنافية كخطوة أولى لضمان مبدأ التقاضي على درجتين، تم توسيع اختصاصات المحاكم الإدارية لتشمل كامل الدعاوى التي تكون الإدارة المحلية أو المركزية طرفا فيها، مما يسمح لمجلس الدولة مستقبلا التفرّغ لتقويم القرارات الصادرة عن الجهات القضائية الإدارية.The amended and supplemented Organic Law No. 98-01, has regulated the competencies of the State Council, which encompass judicial and consultative competencies. The latter how witnessed a noticeable evolution following the constitutional amendment of 2016 which allowed for the expansion of the consultative sphere to the extent of providing opinions as regards legislating by ordinance. Meanwhile in the judicial field, the 2020 constitutional amendment included the establishment of administrative courts of appeal as a prerequisite for the principle of litigation at two lavels, then expanding the competences of administrate courts to include all cases in which the local or the central administration is a party.
