| dc.description.abstract | يلعب موضوع الدراسة دور فعال في المجتمع ، إذ يكتسي الصلح أهمية كبيرة في أغلب المجتمعات حيث أنه يهدف في الأساس لحفظ الأسرة عند قيام أحد الزوجين برفع دعوى فك الرابطة الزوجية أو عند اختلاف الزوجين ، إذ يقوم القاضي بمحاولة حفظ العلاقة الزوجية وتقريب وجهات النظر ومناقشة أسباب ودواعي الطلاق ومن ثم تصالح الزوجين . والصلح في الأساس هو موضوع إجرائي تعرض إليه المشرع الجزائري في قانون الأسرة وكذلك قانون الإجراءات المدنية والإدارية وألزم به القاضي قبل الحكم بفك الرابطة الزوجية ، ويعتبر الصلح آلية لحماية الأسرة من التفكك . كما أن الدراسة الميدانية للصلح على أرض الواقع تظهر عدم نجاعة هذا النظام نظرًا لمجموعة من المعيقات التشريعية و كذلك الاجتماعية و حتى القضائية ، وعلى هذا الأساس كان لزامًا محاولة إيجاد حلول فعالة لنجاح نظام الصلح . الكلمات المفتاحية : الصلح ، الفقه الإسلامي ، قانون الأسرة الجزائري ، العلاقة الزوجية ، دور القاضي ، إشكاليات الصلح . Abstract The role of reconciliation in protecting the family in light of the Algerian family law and Islamic jurisprudence The present study has an effective role in the society. For reconciliation is on a great consideration in most societies where it aims at keeping the ties of families in cases of divorce or disagreement. In such cases , the judge tries to keep marriage and settle the dispute by looking for a ground that satisfies both husband and wife . Reconciliation is basically a procedure that the Algerian legislator dealt with in the family code and also in the Civil and Administrative Procedures Law . The judge in such cases is supposed and obliged to take the reconciliation in consideration before initiating the divorce . The practical study of reconciliation shows its failure because of several legislative , social and judicial obstacles , on this basis it is necessary to find effective cues for this procedure to succeed. key words : Reconciliation .
