Abstract
This master's thesis analyzes the annulment of administrative decisions
within Algerian administrative law. It begins by defining administrative
decisions from doctrinal, legal, and judicial viewpoints. The work
outlines the key elements of a valid decision: cause, competence, form,
object, and purpose. It then explores the legal defects that may lead to
annulment, including lack of jurisdiction, procedural errors, and abuse
of power. The thesis examines the concept of annulment lawsuits, their
characteristics as legal actions, and how they differ from other types of
legal remedies. It details procedural requirements such as prior
administrative complaints, deadlines, and conditions for admissibility.
The research also discusses the termination of administrative
decisions—whether naturally, judicially, or through administrative
withdrawal. A comparative approach with French administrative law is
used throughout the analysis to provide deeper insight into legal
practices and principles.
