Abstract
الصفقة العمومية أداة فريدة وفعالة وضعها المشرع في يد السمطة العامة لتدبير المال العام
وانجاز العمميات المالية المتعمقة بتسيير وتجهيز المرافق العامة ، كما يحظى المنح المؤقت
لمصفقة العمومية باعتباره مرحمة مهمة من مراحل إبرام الصفقات العمومية جانبا مهما ،
لذلك أحاط عممية ابرامها بجممة من القواعد واالجراءات التي يجب اتباعها ، وضبطها بجممة
من الشروط والمبادئ التي يجب مراعاتها بهدف حماية حقوق المتعاممين االقتصاديين من
جهة وتمكين المصالح المتعاقدة من اختيار أفضل العروض المقدمة من جهة اخرى ، وهو
ما ال يأتي دون ضمان تام وكامل لحماية شروط المنافسة وتقييد السمطة التقديرية لإلدارة
عبر االمتثال لممبادئ التي تركن لقواعد المنافسة وتجد سندها في مقتضيات قانون الصفقات
العمومية .
