| dc.description.abstract | قر المشرعال في1990/04/21 المتعلق بعالقة العمل عطلة خاصة تحت مسمى عطلة إلنشاءمؤسسة وما يميزها أنها عطلة بدون أجر يستفيد منها العامل مر ة واحدة خالل حياته المهنية بهدف خلق مناصب الشغل وتفعيل روح المبادر ة االقتصادية. وأثناء فترة عطلة إلنشاء مؤسسة تكون عالقة العمل معلقة، إذ أن المشر ع الجزائر ي أدرجهاضمن حاالت تعليق عالقة العمل بموجب المادة 03 من القانون 16-22 التي تممت المادة 64 من القانون 11-90 وتجدر اإلشارة إلى أن العامل يستفيد من حقوق أثناء سريانها من أهمها احتفاظه بمنصب عمله والرجوع إليه مباشرة بعد نهاية مدتها وفق شر وط منصوص عليها قانو نا. الكلمات المفتاحية:العطلة، إنشاء مؤسسة،العامل، منصب العمل، تعليق عالقة العمل. Abstract: Under Law No. 22-16 completed by No. 90-11 on April 21st, 1990 related to the work relationship, the Algerian legislator approved a special leave under the name of a leave for the establishment of a company, and what distinguishes it is that it is without pay, and the worker benefits from it once during his professional life, with the aim of creating job positions and activating the spirit of Economic initiative. During a leave period to establish a company, the work relationship is suspended, as the Algerian legislator included it among the cases of suspension of the work relationship under Article 03 of Law 90-11. It should be noted that the worker benefits from many rights during the leave, the most important of which is his retention of his work position and to return to it immediately after the end of its period in accordance with conditions stipulated by law.
