    نشأة ديوان المظالم في المغرب الإسلامي

    تهدف هذه الدراسة الى تبيان نشأة وتطور ديوان المظالم، من أبرز ما تناولته هذه الدراسة تعريف ديوان المظالم لغة واصطلاحا ونشأته في المشرق ثم في المغرب ثم عرجنا للتأصيل الشرعي والتاريخي لعمل ديوان المظالم، بينا مشروعيته من الكتاب والسنة ثم الاجتهاد. وفي آخر الدراسة وضحنا أثرديوان المظالم في المغرب الإسلامي سياسيا وعسكريا واقتصاديا واجتماعيا ثم حضاريا، ومن أهم ما توصلت هذه الدراسةهو الدور الكبير لديوان المظالم في حماية الحقوق الأساسية للرعية وما يتوجب للحاكم أو ما ينوب عنه من سلطة اتخاذ القرار لإقامة العدل وإحقاق الحق ورفع الظلم عن الرعية، وإن عمل ديوان المظالم يتركز على رفع الظلم الحاصل من ذوي السلطان والجاه في اتجاه الرعية والنظر بين المتشاجرين وإنصاف المظلومين ومن أهم النماذج لديوان المظالم تحقيق مبدأ المساواة وتحقيق حرية المعتقد وحماية الأقليات وإشاعة مبدأ التكافل الاجتماعي، بل وفي النظر في تأخر أرزاق الموظفين والعاملين. Summary of the Board of Grievances in the Islamic West: This study aims to clarify the emergence and development of the Board of Grievances. One of the most prominent aspects of this study is the definition of the Board of Grievances linguistically and terminologically and its origin in the East and then in the Maghreb. Then we went back to the legal and historical rooting of the work of the Board of Grievances. We highlighted its legitimacy from the Qur’an and Sunnah and then Ijtihad. Then the last chapter came to show us the impact The Board of Grievances in the Islamic Maghreb, politically, militarily, then economically, socially, and then culturally. One of the most prominent findings of this study is the major role of the Board of Grievances in protecting basic rights, despite the decision-making authority of the ruler or his representative to establish justice, realize rights, and remove injustice from the subjects, even if the Board of Grievances works. Grievances are focused on removing injustice committed by people of power and prestige towards the subjects, looking into quarrels, and redressing the oppressed. Among the most important examples of the Board of Grievances is achieving the principle of equality, achieving freedom of belief, protecting minorities, and spreading the principle of social solidarity, in addition to looking into the delay in the salaries of employees and workers.
